A case of prostatectomy that conditioned conflict between the doctor and the patient that was resolved by extrajudicial process

ABSTRACT
We report the case of a 77 year old patient submitted to a radical prostatectomy for prostate cancer. During surgery massive bleeding ocurred; later on, he developed urinary incontinence. The patient complained at The National Commission of Medical Arbitration; both parties accepted the procedures of conciliation and arbitration mandated by the Commission. It was determined that, in spite of both complications, this was not a case of medical malpractice because the surgeon acted according to the standards of ethical and scientific practice of medicine, and within the legal frame in our country.
