ABSTRACT
The purpose of this article is to characterize whether violence against men is also considered gender violence, as well as to analyze its treatment in Venezuelan positive law. Description: In 88% of the cases men abstain from reporting due to shame and because there is a legal vacuum, since the law only classifies a crime as domestic violence when the man mistreats the woman; likewise, 70% stated the non-existence of institutions exclusively for men in matters of gender violence; on the other hand, 90% expressed the lack of legal support, since Venezuelan laws do not typify domestic violence against men, in terms of protection of abused men they are practically null or scarce; finally, 95% of the cases the aggressor was a woman (ex-girlfriend, ex-wife, ex-partner or ex-partner, ex-lover, girlfriend, wife). Approach: in the Venezuelan legal system, violence against men constitutes a serious problem of systematic violation of his rights, which is shown in a dramatic way due to traditional legal conceptions, based on positivist and sexist feminist paradigms. In Venezuela, when a man goes to report an assault, it is processed as a common crime complaint, only one in ten men who is attacked by a woman reports it to the Public Ministry. Conclusions: In Venezuela, as well as in many Latin American countries, the judicial systems are going through moments of crisis and are facing serious problems due to the lack of legislation on violence against men.REFERENCES
