The same-sex violence in México: The context of Nuevo León

ABSTRACT
Introduction. Same-sex violence occurs between affective-sex couples formed by gays, lesbians and bisexuals, or in which at least one member is transsexual, transgender or intersex. Goals. a) The review of the situation of such violence in the context of Nuevo León, b) the identification of the legal characteristics to these situations, c) the analysis of the existence of studies and resources for this type of violence. Methods. A systemic review of studies of the topic exposed in different databases was conducted, and an analysis of the Nuevo León legislation was performed. Results. In Nuevo León there is no specific law for this type of violence, and this behavior does not constitute a case of domestic violence. Faced with such situations, Articles 300-306 of the Penal Code of Nuevo León (Title XV, Chapter 1), as "crimes against life and integrity of persons" are applicable. Moreover, no study of this subject in Mexico was identified, although in other countries there are studies of the existence and prevalence of these cases. Conclusions. This research makes the invisibility of same-sex violence evident, which generates a space enabling secondary victimization. That is why to promote measures to visualize, identify and prevent such violence in Nuevo León is considered necessary.
