ABSTRACT
Introduction: the study emphasizes the process of training the family professional with regard to the legal regulation of custody and care of children in the Cuban Family Code and, in this sense, seeks to overcome the current approach Gender equality, which does not provide equal opportunities for men and women, from the perspective of equity. Objective: to contribute to the training of legal professionals in Cuba, based on the analysis of the gender approach in the care and care of children regulated in the Family Code, from the perspective of equity. Methodology: it is a theoretical research with a descriptive and correlational approach that required the use of methods such as analysis-synthesis related to inductive-deductive and modeling. Development: the professional training process is characterized, with emphasis on the Family Law subject of the Law career, and reference is made to the theory on gender and equity, fundamental for analysis in the current Family Code. Conclusion: the teaching of Family Law from the perspective of equity, in the custody and care of children, is especially important, since the current legislation postulates as a general rule a favorable ruling for the mother being on equal terms With the father, once the marriage bond was dissolved, when the decision-making court should be directed to exhaust all means at its disposal to determine who has "the best right."
