Burnout as a work stress and its forensic dimension

ABSTRACT
This paper discusses the conceptual definition of burnout as a work stress and the relevant dimensions for their evaluation from the clinical standpoint, organizational and forensics. It discusses the legal implications of burnout from the perspective of prevention of occupational risks and the limitations it imposes on the working disability and forensic implications generated in Spain. To this end, it develops a systematic analysis of 160 judicial decisions related to burnout dictated by Spanish courts since the late 90's. We conclude that the syndrome has led to a constant volume of case law in the labor courts, reaching the category of occupational accidents and various degrees of disability. The analyzed data suggest the importance of proper assessment of this phenomenon, given its impact, both prevention and forensic expert.
